Terms and Conditions for Dumpster Rental

Please read these Terms and Conditions (“Terms”) carefully before using the MWA Dumpster Rentals LLC website or booking our services. By placing an order, you agree to be bound by these Terms.
1. Definitions
- “Company,” “We,” “Us,” “Our” refers to MWA Dumpster Rentals LLC, the dumpster rental provider.
- “Customer,” “You,” “Your” refers to the individual or entity booking the rental service.
- “Equipment” refers to the roll-off dumpster, container, and any related accessories delivered to the site.
- “Rental Period” refers to the agreed-upon duration, starting upon delivery and ending upon pickup.
- “Site” refers to the physical location where the Equipment is delivered and picked up.
2. Service Agreement and Rental Period
A. Rental Agreement
By booking a dumpster, you agree to rent the Equipment for the Rental Period and price specified in your order confirmation. You also agree to pay all applicable rental fees, delivery fees, and disposal fees as detailed.
B. Changes to Rental Period
- Extension: Extensions to the Rental Period are subject to Equipment availability and require prior approval from the Company. An additional daily or weekly fee will apply.
- Early Pickup: We do not offer refunds or discounts for early pickups. If you request an early pickup, the initial Rental Period fee remains non-refundable.
3. Customer Responsibilities and Site Access
A. Site Condition and Access
- Safe Access: The Customer is responsible for providing clear, safe, and unhindered access to the Site for both delivery and pickup. This includes ensuring clearance from overhead wires, trees, or low-hanging structures.
- Placement Risk: The Customer is solely responsible for the selection of the Equipment placement location. You understand that the weight of the truck and the Equipment may cause damage to pavement, driveways, grass, irrigation systems, or underground utilities. The Company is not liable for any damage to the Site unless directly caused by the Company’s gross negligence.
- Waiver: By accepting delivery, you waive any claim against the Company for damage to your driveway or property, except in cases of proven gross negligence by our driver.
B. Permits and Regulations
The Customer is responsible for obtaining and paying for all necessary permits, licenses, or authorizations (including street permits, if applicable) required to place the Equipment at the Site. Any fines or delays incurred due to lack of proper permits are the sole responsibility of the Customer.
4. Prohibited Materials and Weight Limits
A. Prohibited Materials
The Customer is strictly prohibited from placing any of the following materials into the Equipment. Fines, surcharges, and immediate removal (without refund) will result if any prohibited items are found.

Hazardous Waste | Asbestos, paint (liquid), chemicals, oils, solvents, batteries, ink/toner cartridges, biological waste. |
Flammable/Explosive | Propane tanks, gasoline, explosives, compressed gas cylinders. |
Electronics (E-Waste) | TVs, computers, monitors, cell phones, fluorescent bulbs. |
Other Items | Tires, appliances containing refrigerants (fridges, AC units), industrial drums, medical waste. |
B. Overweight and Over-filling
- Weight Limits: Each rental size has a maximum included weight limit. The Customer is responsible for all tonnage overages as specified in the original quote, billed at the current per-ton rate.
- Fill Line: The Equipment must not be filled above the top rim (water level). The Company reserves the right to refuse to haul any Equipment that is dangerously over-filled. If refused, the Customer will be required to offload excess material, and a “Wait Time” or “Trip Charge” may be applied.
5. Billing, Fees, and Cancellations
A. Payment
Full payment for the Rental Period is required at the time of booking. Any extra charges (overage fees, prohibited material fines, trip charges, or extension fees) will be billed to the Customer’s card on file after pickup.
B. Cancellation and Refunds
- Cancellations: The Customer may cancel a reservation up to 24 hours before the scheduled delivery date for a full refund.
- Late Cancellation: Cancellations made after the cut-off time may be subject to a Trip Fee of $100 to cover dispatch and scheduling costs.
C. Dry Run/Trip Charges
A Trip Charge (or “Dry Run Fee”) may be applied if the Company attempts to deliver or pick up the Equipment and is prevented from doing so due to:
- Lack of clear access to the Site (blocked driveways, low wires, etc.).
- The presence of Prohibited Materials in the dumpster.
- The dumpster being filled over the maximum fill line.
- Lack of necessary permits.
6. Indemnification
The Customer agrees to indemnify, defend, and hold harmless the Company against any and all claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of or related to the use, operation, or possession of the Equipment during the Rental Period, including, but not limited to, any injury to persons or property damage at the Site.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any major changes by posting the new Terms on this page. Your continued use of the Service after the posting of any changes constitutes acceptance of those changes.
